Sealing Your Records

Before you try to seal your Las Vegas record, you'll need to fulfill the terms of your sentence. For example, if you were ordered five years of probation, you generally couldn't petition to seal your records until those five years have passed. During that time, you can't have committed any other crimes, and you can't be under indictment for further offenses.

In order to seal your Nevada record, you must wait the statutory period from when your case closed:


Category A or B Felony:

15 years from the date released from actual custody or discharged from parole or probation, whichever occurs later.

Category C or D Felony:

12 years from the date released from actual custody or discharged from parole or probation, whichever occurs later. 

Category E Felony:

7 years from the date released from actual custody or discharged from parole or probation, whichever occurs later.

Gross Misdemeanor:

7 years from the date released from actual custody or discharged from parole or probation, whichever occurs later.

Misdemeanor:

2 years from the date released from actual custody or discharged from parole or probation, or when no longer under a suspended sentence, whichever occurs later.

Misdemeanor DUI:

7 years from the date released from actual custody or discharged from parole or probation, whichever occurs later.

Misdemeanor Domestic Violence:

7 years from the date released from actual custody or discharged from parole or probation, or no longer under a suspended sentence, whichever occurs later.

Arrest Without a Conviction:

After dismissal or acquittal, provided there is no evidence that further action will be brought against the individual, an individual who has been acquitted, had his or her charges dismissed, or has had favorable dispositions, may apply to have his or her record sealed.  

Possession of a Controlled Substance:

Certain convictions for possession of a controlled substance not for purpose of sale may be sealed after 3 years if the individual fulfills the terms and conditions of probation or parole and the court is satisfied that he or she is rehabilitated.

After the Record has been Sealed:

The criminal proceedings are deemed never to have occurred and an individual may answer that he or she has never been arrested, and the individual's civil rights restored. By sealing your records, you'll be eligible for jobs that would otherwise exclude you based solely on your Nevada criminal history as well as professional licenses and other civic liberties.
